Camp Ruperto Kangleon, Campetic, Palo, Leyte – 19 PNP operatives, mostly former CIDG8 members involved in the service of warrant that killed former Albuera Mayor Rolando Espinosa in November 2016 voluntarily surrendered to PSUPT JASON MANATAD AGUILLON, the Regional Chief of CIDG at 6:30 in the morning yesterday (March 20) and were brought to the court of origin in Baybay City, Leyte early this morning.
This after PCSUPT ELMER C BELTEJAR, RD PRO8 ordered an extensive manhunt operation on them following the issuance on March 16, 2017 by the RTC Branch 14, Baybay City, Leyte of two (2) Warrants of Arrest against them for Murder in Criminal Cases Nrs. B-17-03-50 and B-17-03-51.
This morning, at about 8:00 AM, CIDG8 detectives together with elements of Regional Public Safety Battalion 8, Regional Intelligence Division, PRO8, Regional Intelligence Unit 8, MARIG8, Baybay City PS and Public Information Branch, LPPO returned the two (2) Warrants of Arrest for Murder and the living persons of PSUPT MARCOS, et al before the sala of Hon. Judge Carlos Arguelles of RTC, Branch 14, Baybay City.
A hearing for the issuance of commitment order was conducted and treating the testimony of Sub-Provincial Jail Wardress on the overcrowded condition of jail facility and upon motion of the respective defense counsels of the accused, the commitment order was held in abeyance and the accused were ordered to be detained temporarily at CIDG8 per Court Order dated March 21, 2017. The case is set for arraignment on March 29, 2017.
As of press time, the composite teams are now in transit to CIDG8 Tacloban City in response to the Court order. The surrenderees who were formerly CIDG8 members are PSUPT MARVIN WYNN MARCOS, PSUPT SANTI NOEL G MATIRA, PCINSP LEO D LARAGA, PSINSP DEOGRACIAS P DIAZ III, PSINSP FRITS B BLANCO, SPO4 Melvin M Cayobit, SPO4 Juanito Duarte, SPO2 Benjamin L Dacallos, PO3 Norman T Abellanosa, PO3 Johnny A Ibañez, PO1 Jerlan S Cabiyaan, PO1 Lloyd O Ortigueza, PO1 Bhernard R Orpilla while former members of the 8th Regional Maritime Unit are PCINSP CALIXTO C CANILLAS, Jr., PINSP LUCRECITO A CANDILOSAS, SPO2 Antonio R Docil, SPO1 Mark Christian Cadilo, PO2 John Ruel Doculan and PO2 Jaime P Bacsal. 11 of them were charged for two (2) counts of murder while eight (8) were charged for only one (1) count of murder. Charged for one (1) count of murder are PSUPT SANTI NOEL G MATIRA, PCINSP LEO O LARAGA, PSINSP FRITS B BLANCO, SPO4 Juanito A Duarte, SPO4 Melvin M Cayobit, PO3 Johnny A Ibañez, PO1 Lloyd O Ortigueza and PO1 Bhernard R Orpilla.They were subjected to regular booking procedure and physical/medical exam just like an ordinary detainee.
It can be recalled that at dawn of November 5, 2016, CIDG8 operatives served two (2) Search Warrants for violation of RA 10591 (Unlawful Possession of Firearm) and RA 9165 (Dangerous Drugs Act) inside Baybay City Sub-Provincial Jail that resulted in the death of detainees Mayor Rolando Espinosa Sr. and Raul Yap who allegedly resisted to the raiding lawmen. A team for the 8RMU served as their perimeter security.
Marcos claimed that what had happened was a shootout but this was refuted during the Senate investigation wherein Senator Panfilo Lacson said that it was a clear case of EJK (Extra Judicial Killing) and thus the operatives are criminally charged in court.
